These Messaging Terms and Conditions ("Messaging Terms") describe how Fabrika ("Fabrika," "we," "us," or "our") provides text message, SMS, MMS, and messaging services—including via third-party platforms such as WhatsApp—(collectively, the "Fabrika Messaging Program"), and the terms that apply when you choose to receive messages from us.
Program Description
The Fabrika Messaging Program may include messages related to:
- Project and engagement updates
- Scheduling, reminders, and follow-ups
- Announcements about our services, availability, or important changes
- Occasional marketing or promotional messages about Fabrika's offerings
Messages may be sent via SMS, MMS, or supported messaging platforms (such as WhatsApp) depending on the channel through which you opted in.
Consent and Enrollment
By providing your mobile phone number and affirmatively opting in—whether by checking an opt-in box on our website, texting a keyword to our number, or otherwise expressly agreeing to receive messages from Fabrika—you consent to receive recurring automated messages from the Fabrika Messaging Program at the phone number you provided. You understand and agree that your consent is being provided to Fabrika and that your opt-in applies to the specific message categories described above.
Your consent to receive messages is not a condition of purchasing any goods or services from Fabrika.
If you opt in through a platform such as WhatsApp, your consent applies to messages sent through that platform. Separate opt-in may be required for each messaging channel.
Message Frequency and Costs
Message frequency varies based on your interactions with us and the nature of your engagement with Fabrika. You may receive recurring messages.
Message and data rates may apply. Please contact your wireless carrier for details about your text messaging plan and any applicable charges.
Opt-Out
You can opt out of receiving messages from Fabrika at any time:
- SMS/MMS: Reply STOP to any message you receive from us. After opting out, you will receive a single confirmation message. No further messages will be sent unless you re-enroll.
- WhatsApp: Reply STOP or use the platform's built-in block or opt-out feature. We will honor all requests to block, discontinue, or otherwise opt out of messages from us.

Privacy and Data Sharing
We care about your privacy and how your information is used. For more details about how we collect, use, and protect your information, please review our Privacy Policy.
Your mobile phone number, messaging opt-in data, and consent will not be shared with or sold to third parties or lead generators.
We will not use information collected through our messaging channels to build marketing profiles of individual recipients beyond what is necessary to provide our services. We do not sell, license, or distribute your messaging data to any third party, except as required by law or as described in our Privacy Policy.
When we use third-party service providers (such as messaging platforms) to deliver messages on our behalf, those providers are contractually obligated to handle your data in accordance with applicable privacy laws and their own platform terms. We remain responsible for the actions of our service providers as they relate to your data.
Platform-Specific Terms
If you communicate with us through WhatsApp or another third-party messaging platform, your use of that platform is also governed by the platform's own terms of service and privacy policy. We encourage you to review the applicable platform terms.
We comply with all applicable platform policies, including Meta's WhatsApp Business Messaging Policy, and with carrier and messaging provider requirements, including those established for A2P (Application-to-Person) messaging in the United States.
Carrier Liability
You understand and agree that wireless carriers are not liable for any delayed or undelivered messages. Delivery of messages is subject to effective transmission by your network provider.
Governing Law
These Messaging Terms are governed by applicable federal laws, including the Telephone Consumer Protection Act (TCPA), and by the laws of the State of Wyoming, without regard to conflict-of-law principles. You agree that any messages you receive from us are sent with your prior express consent as described in these Messaging Terms.
Changes to These Messaging Terms
We may update these Messaging Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued participation in the Fabrika Messaging Program after any changes become effective constitutes your acceptance of the updated terms.
